GEM RESEARCH INDOLAB (GRI)

TERMS & CONDITIONS FOR GEM TESTING & REPORT ISSUANCE
The gemstone, jewelry, or article (hereafter referred to as "the goods") submitted by the Client is accepted by GEM RESEARCH INDOLAB (GRI), a unit of RATNA KAMAL, strictly subject to the following binding terms and conditions:
1. NATURE & SCOPE OF THE REPORT
Professional Opinion Only: Any testing report, certificate, or card issued by GRI is altogether a professional opinion based on gemmological expertise and the technology available at the exact time of testing.
Not an Appraisal or Guarantee: Reports issued by GRI are strictly for identification and authentication purposes. They do not constitute a commercial valuation, financial appraisal, guarantee, or legal document for trade values.
No Offer to Buy: The issuance of a report does not imply that GRI or Ratna Kamal agrees to purchase, replace, or value the submitted goods.
Format & Nomenclature: The content, wording, and layout of the report follow GRI’s standardized formats and terminology, which are subject to updates based on evolving gemmological discoveries and cannot be amended to suit client preferences.
2. DISCLOSURES & TECHNICAL LIMITATIONS
Time-Limited Findings: A gemstone can be treated, modified, re-cut, or enhanced for color and clarity at any time post-examination. Therefore, the conclusions of any report reflect the findings exclusively at the time of testing and issuance.
Treatment Identification & Limits: While GRI utilizes specialized instruments to detect common gemstone treatments, enhancements, or synthetic origins, certain advanced, low-level, or unidentifiable treatments (e.g., specific irradiation or low-temperature heating) may defy standard detection methods. GRI discloses treatments to the best of its technical capability; however, the absence of a treatment comment does not guarantee a stone is completely untreated.
Instrument & Material Variations: GRI is not liable for differences in testing results that may appear from repeated examinations, alternative testing methods, or variations resulting from the inherent mechanical limitations, defects, or errors of the instruments used.
Mounting Limitations: For diamonds and gemstones submitted in mounted jewelry settings, testing and grading are performed strictly within the limitations imposed by the setting. Weights, counts, and metal karats mentioned on the report are as declared by the client, and GRI assumes no liability for their accuracy.
Approximate Visuals: Photographs printed on the report are intended solely as visual approximations of the tested specimen and may vary slightly in color, scale, or appearance due to printing, paper, or camera limitations.
3. LIABILITY & INDEMNIFICATION
Strict Limitation of Liability: In the event of any claim made by the client, their associates, or any third party for damage to the goods, or for damages resulting directly or indirectly from the use of or reliance upon a GRI report, the total liability of GRI and Ratna Kamal shall be strictly limited to the exact fee received for that specific report.
No Liability for Loss or Damage: The client agrees that goods are deposited at their own risk. The client must maintain adequate insurance. GRI, Ratna Kamal, and their staff hold no liability for partial or total loss or damage to the goods via theft, burglary, fire, accidents, force majeure, or handling errors, even if occasioned by negligence or error of judgment.
Fragile Goods & Pre-existing Flaws: GRI is not liable for damages to fragile goods or gemstones with pre-existing internal fractures, cracks, or structural stability issues (like chipped culets or girdles) that may extend or alter during routine laboratory handling. GRI is not responsible for any risks associated with the demounting of stones.
Indemnity Clause: The client hereby agrees to fully indemnify, defend, and hold harmless GRI, Ratna Kamal, and their employees against any and all liabilities, legal expenses, claims, costs, or damages arising out of or related to the testing and reporting of the submitted goods.
4. SUBMISSION, PAYMENTS, & DELIVERY
Right of Refusal: Acceptance of any item for testing is at the absolute discretion of GRI, conditioned by technical limitations and instrument availability.
Delivery Timelines: Scheduled delivery times are minimal estimates, offered on a "first come, first served" basis, and are non-binding. Delays due to technical backlogs, instrument calibration, or complex analyses shall not make the lab liable.
Authorized Collection: GRI presumes the depositor is the rightful owner. Goods and reports will only be delivered to the individual who signed the submission form, or to a third party presenting a valid, signed Authorization Letter.
Payment Terms: Services are rendered strictly against advance payment. In instances of authorized post-payment, GRI reserves the absolute right to withhold and retain the goods and reports until full clearance of the invoice amount is confirmed.
Unclaimed Goods: Clients must collect their goods and reports within 30 days from the date of testing. If goods remain unclaimed after 30 days, GRI reserves the right to forfeit the items or charge storage fees at its sole discretion.
5. DATA USAGE & REPORT INTEGRITY
Data & Research Rights: The client permits GRI to utilize, store, or publish the scientific data, features, and photographic images recorded from the gemstone analysis for research, statistical, or promotional purposes. The client retains no legal rights over this data, and GRI is not bound to credit the client’s name.
Tampering & Digital Verification: Any form of tampering, doctoring, unauthorized addition, or deletion to a physical report renders it completely void and infructuous. Web-downloaded reference copies are for reference only and do not substitute the original security-printed report.
Right to Void: GRI reserves the absolute right to declare an earlier issued report void under the direction of the laboratory management if subsequent discrepancies or errors are identified.
6. JURISDICTION & DISPUTE RESOLUTION
Time-Bound Grievances: Any dispute or complaint regarding a testing report or service must be brought to the formal notice of GRI management in writing within fifteen (15) days of the report's issuance; complaints raised thereafter will not be entertained.
Governing Law: Any dispute arising out of or in connection with reports issued by GRI shall be governed by the laws of the country, and the courts of Gwalior only shall hold exclusive legal jurisdiction.
